Hotel Hanga Roa: Corte de Apelaciones de Valparaíso rechaza apelación de familia Schiess


On Wednesday, February 23, 2011, the Court of Appeals announced that Valparaiso had rejected the appeal filed by the family Schiess and the Public Ministry to the decision of the Judge Nora Bahamondes, which implemented protective measures for the Hitorangi clan. The Schiess corporation are trying to press charges of “usurpation” by the Hitorangi of the Hanga Roa hotel.

The argument took place on February 22, with trial lawyers: Rodrigo Gómez, by Milestone, Samuel Nunez, the Prosecutor, and Julian Lopez, by Schiess. The vote was two votes to one, in favor of Hitorangi.

Francisco Marín, representing the Hitorangi clan on continental Chile, said that with this ruling, “the Chilean Justice confirmed that the owner of the land where the Hotel Hanga Roa is located must be settled. This is a huge victory for the Hitorangi clan and Rapa Nui, because it demonstrates the righteousness of our struggle and the seriousness of our work.”

Marin said that with this ruling, “the announcement, made last week by Interior Minister Rodrigo Hinzpeter and foreign investor Jeannette Schiess– that the Schiess would be “donating” the land to a foundation run by Petero Edmunds– was nothing more than a publicity stunt.

As a result of this ruling, work at the Hotel Hanga Roa remain stalled until there is a tripartite agreement involving the three parties involved: The Hitorangi, the State of Chile and Schiess.
